Welcome to The Photography Auction.

This is our first online auction of Fine Art Photography. It is, as well, the Internet' s first auction for serious fine art of any sort.

The Photography Auction is a collaboration between PhotoArts and the respected experts Beth Gates Warren and Dale W. Stulz. The Internet has permitted us to build a new organization serving the International marketplace for fine art photography.

This Internet auction serves the broadest possible audience of buyers and sellers. It does so with efficiency and economy. We have designed an online bidding mechanism that is reliable and easy to use.

Ms. Warren and Mr. Stulz have provided extensive documentation for each lot. Our Guarantee of Authenticity protects the buyer.

Commencing 21 April, there is a public viewing of the works at auction at Howard Schickler Fine Art in NYC.

We invite you to join us in establishing the Internet as an indispensable tool of fine art commerce.

The online registration form is used to submit the information necessary to approve and confirm your participation as a bidder.

Upon confirmation, you will receive a paddle #. This paddle # is linked to your e - mail address and identifies the current high bidder on the Bid Board.

The information you provide is not shared with any other parties and, thus, you are assured complete anonymity. If you wish to contact us by phone, fax or e - mail you may do so.

NOTE: Online Registration will close at 9 PM (EST) 15 May 1998. After that time, at the sole discretion of the auctioneer, bidders known to the auctioneer may be confirmed for bidding.

The navigation bar at the top of each page has a link "index" to the Artists Index page. Here you will find an alphabetical listing of all artists represented and the corresponding lot numbers.

Click on any artist' s name and you will go directly to their lot in the catalog pages. If they have more than one lot, you will be sent to the first.

An online catalog of the lots at auction is linked to individual Condition Reports for each lot.

The Condition report page presents, in addition, enlarged images for each lot along with a view of the back and / or detail when relevant; the auctioneer' s condition report; artist bio; and supplementary notes.

The catalog pages contain 6 - 8 lots each with an image of each with standard description. ( lot #, artist, title, date, medium, size, estimate ). There is a link to the catalog pages on the top navigation bar.

On the left side of the catalog page there is a separate frame which contains the current high bid for each lot. This list is refreshed, automatically, every 10 minutes. (You can update immediately by clicking reload/refresh)


 H O W  T O  B I D

To bid, you must be registered. All bidding is done on the Bid Board page.
All the lots at auction are indicated on the Bid Board with the following information:

Lot#
Artist' s Name
Current High Bid
ID# of Current high bidder
Next Bid Increment (Bid Button).

The Bid Board is automatically refreshed every 3 minutes You may click reload/refresh for immediate update.

The Bid Button indicates the next bid based on the increment in effect increment schedule

[Clicking on the lot# will send you to the condition report page for that lot. Clicking on the current high bid will send you to the bidding history for that lot.]

n o t e:
Order Bids will be accepted from registered bidders by e - mail, fax or phone. Please include your paddle # and e - mail address in any communication.

Each time you begin a new online bidding session you will be asked to enter your e - mail address and paddle# when you make your first bid. (If your bidding activity is idle for a long time this information may be requested again.)


 * * C O O K I E   M O N S T E R

"Cookies" are the server's way of identifying you during a bidding session and must be accepted in order to conduct online bidding. They contain no personal information about you. If you are receiving "Cookie Alerts" they will impede your participation as an active bidder. You must turn off the "Cookie Alert" in your browser preferences.

When you bid on any lot you will be asked to confirm your bid. You will then be informed that your bid was accepted and you will be returned to the Bid Board.

As the high bidder, the Bid Board will show a red dot as the current high bid for that lot. This indicates that you are the current high bidder for that lot, at the increment you submitted. The Bid Button will not show a numerical value indicating that, as high bidder, you should not bid again.

It is possible that the bid you submit is not accepted. This means that another bidder has placed a bid just before yours and it was accepted at the then current increment. You will be returned to the Bid Board where the new high bid will be indicated along with the next bid increment. You may bid again at this time.

If you are the high bidder and your bid is topped, you will receive an e - mail message informing you that you are no longer the high bidder.

All telephone bidders wishing to bid at the closing of bidding must make prior arrangements.

All bids by fax or e - mail must be received by 9 a.m. (EDT) on May 16, 1998. At that time the auctioneer will post those bids.

Duration and Close of Bidding

Online bids will be accepted beginning 6 May. (Order bids will be accepted from registered bidders prior to this date, by [e - mail, fax or phone]).

The bidding will close on 16 May beginning at 1PM EST. The lots will close out in sequence, one at a time, according to lot#. Lots 1 - 27 will begin closing at 1PM; lots 28 - 54 will begin closing at 2:30PM.

Bidding will close on each lot when there no longer active bidding. The closing of each lot will be at the sole discretion of the auctioneer Dale W. Stulz.

All decisions by the auctioneer are final.



Conditions of Sale

The Photography Auction will receive a premium to be collected from the Buyer of 15 % of the final bid price up to and including $ 50,000 plus 10 % of the final bid price above $ 50,000.
In addition the Buyer is responsible for all packing and shipping charges.
All successful bids are subject to a Seller's Reserve (the confidential minimum price that a seller will take for his lot). All lots have a Seller' s Reserve.
All successful bids will be notified within 3 days of the closing of bidding by fax, e - mail or letter. All invoices must be paid for in full within 10 days of the closing of bidding.

Any failure on behalf of the successful bidder to settle their purchase will result in the lot being offered to the next highest bidder.

The Photography Auction reserves the right to withdraw the property at any time before sale for any reason, and in no event shall The Photography Auction be held liable for failure of any lot of property to be sold.

The Photography Auction reserves the right to open and close bidding at its absolute discretion.


Guarantee of Authenticity

The Photography Auction provides a guarantee for all works sold. This guarantee is as follows:

There is an unconditional guarantee of authenticity, provided that the Buyer produces satisfactory evidence to us that a lot is not authentic, within two years of the auction date, and is solely for the benefit of the Buyer as stated on the invoice.

There is a limited guarantee that any lot may be returned if its condition is not as stated on the condition report as provided by The Photography Auction.
A lot may only be returned for refund if the Buyer notifies The Photography Auction within 3 days of receipt that the condition of the lot is not as stated in the on-line catalog, and the lot must then be immediately returned at the Buyer's expense to us in the same condition as received, fully-insured against loss in shipping. The Buyer will be refunded within thirty days of receipt of the item less a charge of 5% for expenses



 R E S U L T S

The closing prices of each lot will be immediately viewable on the BidBoard.
Following the close of the auction, and within seven days, the closing prices will be entered into the online catalog following the estimated price for each lot.
